Introduction of 2nd Generation Tobacco Products and the Need for Change in Tobacco Control Policy

Abstract
This study examined the limitations of domestic tobacco control policies in Korea, specifically the Tobacco Business Act and the National Health Promotion Act, which were designed during an era when conventional cigarettes dominated the market. As new tobacco types such as e-cigarettes and heated tobacco products emerge, these laws face challenges to effectively regulate them. This study explored the introduction of "second-generation tobacco products" into the domestic tobacco market and argues for the necessity of reevaluating tobacco-related laws. Increasing emphasis on tobacco control policies and the negative public perception of smoking have prompted tobacco companies to invest in novel products. The potential entry of smokeless tobacco products, including nicotine pouches, into the domestic market requires a proactive review and revision of existing legislation. This entails examining the definition of tobacco, criteria for imposing tobacco taxes, regulations on tobacco product usage in non-smoking areas, and measures to prevent indiscriminate market entry. Continuous monitoring of emerging tobacco products is crucial, and must be accompanied by efforts to amend and supplement existing laws to align with evolving tobacco products and usage patterns.
